When you file your letter of intent it is the responsibility of the notified parties to contact their underwriter and report a claim against their insurance policy.  However we are finding that PEOPLE ARE NOT DOING THIS.

BEFORE YOU FILE YOUR CLIAM PLEASE READ!!!  

1.) Do not let them intercept your claim!! 
Sometimes they will tell you they are sending you to a “claims department” but they are actually sending you to the Risk Management department in an effort to block you from filing an actual claim.  Each insurance company uses underwriters to write their policies. You must file a claim with the PRINCIPAL INSURANCE COMPANY ONLY! 

2.) Identify the type of claim you will file.

  • A bond claim  is filed on a Surety Bond that covers an individual(s) in a blank bond.
  • An Insurance policy is a Umbrella coverage for entire County/City/School and will have a policy number.
  • A Memorandum of Coverage: They are self-insured, this will not look like a “normal” policy and will not have a policy number (Almost all officials in California and most states are Not Bonded).

3.) Do not call the insurance company!
Many insurance companies have an online form or an email address you should fill out in order to file your claim. If they do not provide one of these options, they are not legitimate. 

4.)  Include your letter of intent and the policy number when you file a claim.   

5.) Identify the PRIMARY insurance company!
Below is a list of companies that we have found so far when people submit their policies to us.  Each of these companies are approved by the Federal Government to issue Surety Bonds.

If you don’t see your provider in the list above, check out the official list of federally approved carriers in the United States.  This is a great resource for skipping past the underwriters. 

Be sure to create SEPARATE CLAIMS for each elected official and each notifying party!!

The goal is to have as many claims pile up as possible.  They will try to lump your claims together but do not allow them to do this. 

GIVE EACH CHILD A VOICE!

  1. When filing a claim you will need to file separate claims for each person. If you have a group of people who have served letters of intent they will need to file their own claims.

  2. To file a claim you will need to:
    1. State the insurance policy number
    2. The name of the person you are filing against
    3. The reason for filing this claim
    4. The laws that have been broken
    5. The amount of damages you are seeking
    6. It is a good idea to name the government office/name of official/school district
    7. Address of the government office/school district
    8. The person’s position if they are a government official or a public official

  3. You will use the same procedure if you are filing against a bond. Most companies writes Surety Bonds and Insurance Liability Policies in lieu of Surety Bonds.

  4. If your claim is denied, file again, keep filing until they read your claim or act upon your claim.

  5. The more claims that are filed against a single policy the insurance company will cancel this policy. Most of the schools or government offices have had their policies canceled in the past. They will not be able to find a new insurance company. If the insurance is cancelled then the person is removed from office.

  6. Once you have completed filing your claim, a claims adjustor has contacted you and you have a claim number it is your responsibility to contact the person you filed a claim against. You will need to send this person a registered letter with the information that a claim has been filed against their insurance liability policy or their surety bond.

  7. Filing a claim online you should receive a confirmation number or a claim ID once you submit the claim.

  8. If they deny this claim for any reason you should file the claim a second time. Change the information or the laws you sited when you filed the first claim. Keep filing the claims until they are accepted.
